320 HLSTORY OF MARYLAND. to govern this Province, & most assuredly he will then call an Assembly wch we doubt not will be in Octobr next, at farthest time enough to perfect and settle the affaires of this province, therefore, are not willing to run ourselves into the Extraordinary Charge'of two. assemblies, imediately one upon the back of the other, wee likewise are satisfied that noe persons doe nor will disturb those persons that have the possession of the said Magazines, records, and doe expect that they will keepe them safe & deliver them to a Lawfull Authority when it comes from England, therefore wee will choose noe Burgesses or delegates to sitt in Assembly untill a lawfull power from England require the same. (his x Merk) Hinton, Hugh (his x Merk) Chintons, James (his x Merk) Baddcock, James Dossey, John Stone.1 This declaration, which Sheriff Taney says was signed by " the better sort, of people," drew upon him the wrath of Coode and his followers, who ordered his arrest. He thus describes their behavior: " I was fetched from my house on Sunday the 25th of August, 1689, by James Bigger and six other armed men, by order of the persons assembled at the command of Coad and his accomplices, and kept close prisoner at the house of Philip Lyons, under a guard of armed men, and, upon the 3d day of September, carried by a company of soldiers before ye said Assembly, where Coad accused me of rebellion against their majesties, King William and Queen Mary, for acting as above written, and withal told me if I would submit to a trial they would assign me counsel. Whereto I answered them that I was a freeborn and loyal subject to their majesties of England, and therefore expected the ben- fit of all those laws of England that were made for the preservation of the lives and estates of all such persons, and, therefore, should not submit myself to any such unlawful authority as I take yours to be. Whereupon they demanded of me who was their majesties' lawful authority here? I answered, I was, as being an officer under the Lord Balltamore, until their majesties' pleasure should be otherwise lawfully made known- Then they ordered the soldiers to take me away awhile, and soon after ordered my bringing in again before them, with Mr. Smith and Mr. Botler, telling us it was the order of the House that we must find good and sufficient security to be bound for us to answer before their majesties' commissioners and lawful authority what should be objected against us, and in the mean time be of good behavior. To which we answered, their authorities we looked upon not lawful to force us to give any bonds, and that we had estates in this country sufficient to oblige our staying to answer what any lawful authority could object against us.
